The complaint that the claimant was unfairly dismissed is struck out.REASONS
[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years’ service to make an unfair dismissal complaint.[3]The claimant was employed by the respondent for less than two years.[4]Therefore the claimant is not entitled to bring such a complaint.[5]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the complaint should not be struck out.[6]Accordingly, the complaint of unfair dismissal is struck out. The claimant’s other complaints are not affected by this judgment. _____________________________ Employment Judge Ramsden Date: 8 May 2024 Case No: 2305501/2023 6.2 Strike out Judgment – claim - rule 37 EMPLOYMENT TRIBUNALS Claimant: Glenes Awuah Respondent: Woodlands Health Centre[1]By a letter dated 23/01/2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim of unfair dismissal should not be struck out because:• it has no reasonable prospect of success.[2]By a letter dated 07/06/2024 the respondent applied to the Tribunal for the claims of breach of contract and unlawful deductions from wages to be struck out because:• the claimant had not complied with the Order of the Tribunal dated 30/01/2024[3]In accordance with Rules 30(2) and 92 of the Employment Tribunal Rules of Procedure, the respondent sent a copy of the application to the Claimant and notified them that any objections to the application should be sent to the Tribunal as soon as possible.[4]The claimant has failed to make any representations in writing why this should not be done or to request a hearing.[5]The case was listed for hearing today and the claimant did not attend.
