Mr S Rahman v JD Sports Fashion plc: 2305274/2019

EMPLOYMENT TRIBUNALS
Case No 2305274/2019
Mr S RahmanClaimantJD Sports Fashion plcRespondent
Employment Judge Hyams-ParishDate 6 July 2020

JUDGMENT

The claim is struck out on the grounds that(i) the Claimant has failed to comply with an order of the Tribunal; and(ii) the claim has not been actively pursued.

REASONS

[1]The Claimant was sent a letter by the Tribunal dated 23 June 2020, warning him that the Tribunal was considering whether to strike out his claim as he had not complied with Tribunal orders (contained in a case management order dated 11 February 2020) and because the claim had not been actively pursued.[2]The Claimant was asked to provide his comments to the above by 30 June 2020.[3]Nothing has been received by the Tribunal from the Claimant in response to the above letter. In the absence of any representations from the Claimant the Tribunal is satisfied that the Claimant has failed to comply with orders contained in the above case management order and that he is no longer actively pursuing his claim, given that he is failing to engage with the Respondent and the Tribunal concerning his claim.[4]In the circumstances, the Tribunal considers it appropriate to strike out all of the claims brought by the Claimant, such claims being dismissed. ……………………………………………… Case No: 2305274/2019
