The claim is struck out.REASONS
[1]A preliminary hearing was conducted by telephone on 26 January 2022, which the claimant did not attend despite three attempts to contact her by telephone.[2]At that hearing the claimant was ordered to provide further information of her claim by 18 February 2022 as to whether she wished to continue with her claim and, if so, she was required to provide specific details or whether she wished to withdraw her claim. The case management summary made it clear that if the claimant had not responded by the date required, a judge may decide that the claim should be struck out on the grounds that it is not been actively pursued.[3]Unfortunately, the case management summary containing the order was not sent to the parties until 28 March 2022. However, as of the date of this judgment the claimant has still not complied with the order and there has been no contact from her since she lodged her claim which was received on 22 September 2020.[4]Consequently, the claimant’s claim is struck out on the basis that she has not complied with the order of the Tribunal dated 26 January 2022 and the claim has not been actively pursued.
