JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the London South Employment Tribunals on 27 September 2023. The respondent has failed to present a valid response on time.[2]At a hearing attended by the claimant the Employment Judge decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure. 2. The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £1,247.56 gross.[3]The claimant’s award comprises:a. unpaid salary for the period 28 May to 7 June 2023 inclusive at a daily rate of £96.15; andb. unpaid commission of 2.5% on the respondent’s fee of $21,250 at a conversion rate of 0.79. Interest for delayed receipt has been applied at the rate of 5%. 3. The claimant is responsible for accounting to HMRC for any income tax and National Insurance contributions due on this award.
