Miss Bonney v Mr Lee: 2305168/2023
JUDGMENT
[1]The claim is dismissed.REASONS
[1]The Claimant did not attend this hearing nor did the Respondent (who has not entered a response). The same is true of the last hearing which took place on 19 February 2024. At that hearing EJ Hanning made various case management orders. Those orders have not been complied with and in fact there has been no correspondence from the parties at all. The tribunal’s clerk attempted to telephone the Claimant using the number given in the ET1, but without success. She left a voicemail at about 2.05pm. By 2.30pm the Claimant had not responded.[2]I have decided that the appropriate course is to dismiss the claim pursuant to rule 47. There is no explanation for the Claimant’s absence either today or on 19 February 2024. Reasonable efforts have been made to contact the Claimant.[3]All in all, it appears that the Claimant has decided to abandon the claim and no longer wishes to pursue it. In the circumstances, it is best if I dismiss it today.
