JUDGMENT
[1]The correct name of the Respondent is agreed to be Mint Dental Clinic Limited. It shall be amended thereto.[2]All claims, insofar as they relate to the person of Mr R Patel (director of the Respondent), are dismissed.[3]Having heard from the Claimant and in the absence of the Respondent - who requested that the hearing proceed in their absence, I find that the claim for unlawful deduction from wages is made out and the claim, subject to what follows, succeeds.[4]In her ET1 claim form, the Claimant had used the figure of £15.63 per hour having divided her annual salary by 12 (months), the result by 4 (weeks) and that result by 40 (hours). In fact, she agreed at the hearing that this was incorrect and that the figure of £14.42 was applicable being her annual salary divided by 52 (weeks) and then by 40 (hours).[5]IT IS DECLARED that the Respondent made an unlawful deduction from the wages properly due to the Claimant.[6]As a result of the foregoing, IT IS ORDERED that the Respondent shall pay, immediately, to the Claimant the sum of £713.79 less any lawful deductions due to HMRC for which the Respondent shall properly account.
