JUDGMENT
[1]The following complaints are dismissed upon withdrawal:1.1 All complaints of failure to pay holiday pay except that of Mr Connolly1.2 All complaints of failure to pay other payments1.3 Mr Ujjan’s complaint that he was unfairly dismissed because he made a protected disclosure1.4 Mr Noufal’s complaint that he was unfairly dismissed because he made a protected disclosure brought against the first respondent by Case No. 2305926/2024 on the strict basis that he has brought exactly the same complaint against the first respondent in Case No.2305934/2024 which is unaffected by this withdrawal and dismissal1.5 If and insofar as any claim against Mr Drennan has been accepted, it is dismissed upon withdrawal.[2]The following complaints are struck out because the claimants have not been continuously employed by the first respondent for a period of not less than 2 years:2.1 Mr Noufal, Mr Ujjan, Mr Lainchbury and Mr Kelly’s complaints of unfair dismissal (whether ‘ordinary’ unfair dismissal or ‘automatically’ unfair dismissal pursuant to regulation 7 TUPE 2006) and2.2 Mr Noufal, Mr Ujjan, Mr Lainchbury and Mr Kelly’s complaints that they were not paid a redundancy payment brought pursuant to s.163 ERA 1996.
