JUDGMENT
It is the Judgment of the Tribunal that the Claimant’s complaint of unfair dismissal is struck out.REASONS
[1]Under section 108 of the Employment Rights Act 1996 claimants are not entitled to bring a complaint of unfair dismissal unless they were employed for two years or more except in certain specific circumstances which do not seem to apply here.[2]At the hearing on 22 March 2024 the Claimant agreed he had been employed for less than two years. A strike out warning was given and the Claimant had until 5 April 2024 to give reasons in writing why his complaint of unfair dismissal should not be struck out. He did not do so.[3]The claim is therefore struck out as it has no reasonable prospects of success.[4]The Claimant’s complaints of disability discrimination continue.
