[1]The Claimant has failed to comply with the case management order of 2 November 2022, in that he has failed to provide a witness statement.[2]The Claimant is not actively pursuing the claim. The Tribunal notes that he did not attend the last hearing, did not attend this hearing and has failed to engage with the Respondent or follow case management orders.[3]The Claimant has not contacted the Tribunal to seek an extension of time or explain their non-attendance today.[4]The Respondent’s application to strike out the claim under Rules 37(1)(c) and 37(1)(d) of the Employment Tribunal Rules of Procedure 2013 (as amended) is allowed.[5]The Claimant’s claim is hereby struck out under Rules 37(1)(c) and 37(1)(d).
