Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the London South Employment Tribunals on 11 September 2023. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The claimant was dismissed in breach of contract in respect of notice pay calculated at £114 x 3 and the respondent must pay damages to the claimant of £342.00 net.[3]The claimant was dismissed by reason of redundancy and the payment of £855 paid to the claimant was wrongly subjected to 20% tax deductions. The claimant is therefore entitled to a sum of £171.00 calculated at £855 x 0.2.[4]The respondent must pay the claimant £513.00 in total.[5]The hearing listed on 30 January 2024 is cancelled.
