JUDGMENT
Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 – Rule 21[1]The Respondent has made an unauthorised deduction from the Claimant's wages and is ordered to pay the Claimant unpaid notice pay in the gross sum of £3,156.25.[2]The Claimant is responsible for payment of tax and national insurance due on this sum, if any. ………………………………………………REASONS
[1]On 24 October 2020, the parties were sent a Judgment in this case made by Employment Judge Hyams-Parish on 19 October 2020. This Judgment upheld a claim for unlawful deduction of wages pursuant to Rule 21 of the Employment Tribunal rules, in the absence of any response received from the Respondent.[2]It later transpired that there had been an administrative error and the response had been received within the applicable time limit.[3]In the circumstances it is the interests of justice that the Judgment is revoked.[4]The parties will be informed of the next steps in due course. ………………………………………………
