Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the London South Employment Tribunals on 15 September 2021. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £2983.75 net.[3]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant of £673.45.[4]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £444.85.[5]The respondent must pay the claimant £4102.09 in total.[6]The hearing listed on 23 June 2022 is cancelled.REASONS
[1]Upon receiving the ET1 claim form on the 15 September 2021 the claim of unfair dismissal has been struck out due to the reasons set out below;• The claimant did not have the qualifying two years’ service under section 108 of the Employment Rights Act 1996 or any exceptional circumstances that provide for an exemption to the qualifying service period.[1]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out.[2]This judgement applies to all other claimants that are party to this claim as set out below.[3]The claimant’s and all other claimants remaining claims continue.
