JUDGMENT
[1]The correct title of the respondent is “MCCB Ltd t/a Bright & Beautiful” and the title of the proceedings is amended accordingly.[2]The claimant’s complaint of unlawful deductions from wages contrary to Part 2 of the Employment Rights Act 1996 was not presented before the end of the period of three months beginning with the date of payment of wages from which the deduction was made.[3]The Tribunal is satisfied that it was not reasonably practicable for the complaint to have been presented before the end of that period, as required by section 23(2)(a).[4]However, the complaint was not presented within such further period as the Tribunal considers reasonable, as required by section 23(4).[5]The claim is dismissed.
