The Claim is struck out.REASONS
[1]The Tribunal gave directions to the Claimant on 23 November 2023 to comply with in respect of his claims for unfair constructive dismissal and listed the matter for a two-day hearing on 25 and 26 March 2024.[2]The Claimant did not comply with the directions and did not attend the hearing. Prior to the hearing, the Respondent wrote to the Claimant to confirm that it would be making an application to strike out his claim for failing to comply with the Tribunal directions and not actively pursuing his claim.[3]The matter came before the Tribunal again on 17 April 2024 and the Claimant had not responded to the Respondent or the Tribunal. He had still not complied with the Tribunal directions or actively pursued his claim.[4]Accordingly, the claim is struck out under rules 37 (1) (C) and (d) of the Employment Tribunals Rules of Procedure 2013.
