Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant’s claims against the First Respondent are dismissed as the tribunal has determined that the legal identity of the employer was the Second Respondent.[2]The Second Respondent made an unauthorised deduction from the Claimant's wages and is ordered to pay the Claimant the gross sum of £2519.20 which is formed of £1519.20 loss of earnings; £600 loss of commission payments and £400 loss of benefits.[3]No award is made in respect of expenses incurred in seeking new employment as no detail has been given for these expenses.[4]No deduction shall be made in respect of holiday pay already received as the Claimant is entitled to be paid in lieu of accrued but untaken leave.[5]Total award £2519.20 (gross).
