The claim is not being actively pursued and is struck out pursuant to rule 37(1)(d) of the Employment Tribunal Rules 2013. The hearing on 3 February 2021 vacated.REASONS
[1]At a preliminary hearing on 8 July 2019 a number of orders were made that the claimant had to comply with including providing a schedule of loss and disclosure of documents. The claimant did not comply with those orders despite being reminded and chased by the solicitors acting for the respondent.[2]Those solicitors emailed the claimant on 14 July 2020 requesting a response failing which they would apply for his claim to be struck out. He did not reply and they made that application on 20 July 2020.[3]On 5 December 2020 the Tribunal wrote to the claimant notifying him that consideration was being given to striking out his claim and inviting his comments by 12 December 2020. No reply has been received.[4]It appears that the claim is not being actively pursued.
