JUDGMENT

The Claimant having failed to respond to the strike out warning sent to the parties on 22 September 2020, it is the judgment of the Tribunal that: The claim is struck out.

REASONS

[1]By order sent to the parties on 22 September 2020 Employment Judge Martin said that she was considering striking out the Claimant’s claims because the Claimant had failed to attend the preliminary hearing, failed to comply with the orders made on 22 October 2019 and/or the claim was not being actively pursued. The Claimant was given 14 days to provide reasons in writing to explain her non-attendance and explain why she had failed to comply with the orders.[2]The Claimant has not corresponded further with the Tribunal or, according to the Respondent’s representatives, the Respondent. The Claimant has had ample opportunity to explain her non-compliance and has not done so. The claim is therefore struck out pursuant to Rule 37 on the grounds that the Claimant has failed to comply with Tribunal orders and the claim has not been actively pursued.
