It is judgment of the Tribunal that the claimant’s claims are determined on the following basis:[1]Agency Workers Regulations 2010, claim for comparable hourly rate to an employee of the end user - dismissed as the claimant conceded she had received this payment.[2]Working Time Regulations 1998, claim for unpaid holiday of £2627.60 - succeeds and the respondent is ordered to pay this sum (this is a gross figure and therefore appropriate deductions need to be made or accounted for to HMRC).[3]Timesheets not paid - dismissed as the claimant conceded they had been paid, albeit late.
