JUDGMENT

The judgment of the Employment Tribunal is as follows:[1]The claim of constructive unfair dismissal against the First Respondent is struck out as it has no reasonable prospect of success[2]The claim of unfair dismissal against the Second Respondent is struck out as it has no reasonable prospect of success[3]The complaint of discrimination on grounds of race against the First Respondent is struck out as it has no reasonable prospects of success.[4]The complaint of discrimination on grounds of race against the Second Respondent, insofar as it related to fatigue, is struck out as it has no reasonable prospects of success.[5]The complaint of discrimination on grounds of race against the Second Respondent, insofar as it related to being refused permission to work at home/required to work in the office was not presented in time in accordance with section 123 Equality Act 2010.[6]It was not just and equitable in all the circumstances to extend time in accordance with section 123 Equality Act 2010.[7]Accordingly, that part of the case is dismissed because the Tribunal does not have jurisdiction to hear the complaints brought in this claim because they were presented out of time.
