JUDGMENT
The claimant has failed to comply with the Strike Out Warning dated 22 May 2023 and accordingly the claim is struck out pursuant to Rule 37(c) and (d) Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, Schedule 1.REASONS
[1]By a letter dated 22/05/2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claimant had not complied with the Order of the Tribunal dated 22/11/2022. it has not been actively pursued. 6.2 Strike out Judgment – claim - rule 37 Case No:2304114/2022[2]The claimant failed to make representations in writing why this should not be done or to request a hearing.[3]The claimant did not attend the hearing fixed for 05/06/2023. The respondent did attend. Attempts were made to contact the claimant by telephone but she was not reachable. A voicemail was left to confirm that the hearing was proceeding and to provide a telephone number for her to contact the Tribunal.[4]The claimant was given time to contact the Tribunal in response to the voice message but failed to do so.[5]The claim is therefore struck out.
