The claimant did not have the necessary two-year qualifying period of service at the date of dismissal, as required by section 108 Employment Rights Act 1996. JUDGMENT The complaint of Discrimination on the grounds of Race and Age is struck out. REASONS[1]The claimant was ordered to pay a deposit of £10 in respect of each claim (£20 in total if both are pursued) following a preliminary hearing held on 15 February 2023. The Order was sent to the claimant on 22 February 2023.The claimant has failed to pay this deposit. The complaint of Discrimination on the grounds of Race and Age is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 18 October 2023 will not take place.
