JUDGMENT

[1]The complaint that the Respondent made unauthorised deductions from the Claimant’s wages during the period 28 March 2019 to December 2023 in respect of holiday pay, contrary to section 13 of the Employment Rights Act 1996 (the 1996 Act) does not succeed and is dismissed.[2]The complaint that the Respondent failed to give the Claimant a written statement of employment particulars within eight weeks of his employment beginning on 28 March 2019, contrary to section 1 of the 1996 Act, succeeds.[3]The complaint that the Respondent failed to provide the Claimant with any itemised pay statements for the period 2019 to 2023, contrary to section 8 of the 1996 Act, succeeds in respect of March 2019 only, and is dismissed in respect of the period April 2019 to 2023.[4]The complaint that the Respondent failed to provide the Claimant with itemised pay statements in respect of the period January to April 2025, contrary to section 8 of the 1996 Act, succeeds.[5]The Claimant’s remedy in respect of those complaints above that succeed is a declaration to that effect, which declarations are set out above.
