JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim succeeds and the remedy to which the claimant is entitled will be determined at a Remedy Hearing.[2]The hearing listed on Hearing Date is cancelled. Judge M Aspinall (sitting as an Employment Judge) Date: 11 April 2024[1]The Second Respondent Mr Zac Hemming is added as a respondent to claim number 2303721/22. Case Number: 2303721/2022 and 2302776/2023 2[2]The claim for pregnancy discrimination brought under claim number 2303721/22 is well founded and it succeeds against both the First and Second Respondents.[3]The First and Second Respondent shall pay the claimant a sum of £5000 compensation for injury to feelings on a joint and several basis.[4]The claim for unlawful deductions from wages brought under claim 2303721/22 is well founded and succeeds against the First Respondent only (as the employer of the Claimant).[5]The First Respondent shall pay the Claimant a sum of £4000 (net) in relation to arrears of wages[6]No response having been presented, on 11 April 2024 judgment was entered against the Second Respondent only in relation to claim number 2302776/23[7]The Second Respondent shall pay the Claimant the following sums by way of compensation for pregnancy and maternity discrimination:a. £19,200 as compensation for past financial losses (representing twelve months’ net loss of wages for the period August 2023 to August 2024);b. £10,000 compensation for injury to feelings:[8]No compensation is payable by the Second Respondent in relation to the claims of unfair dismissal, for holiday pay and for unlawful deductions from wages under claim number 2302776/23 as he was not the Claimant’s employer.[9]The Claimant shall be responsible for any tax due on the sums awarded.[10]The total sum awarded to the Claimant is £38,200.
