JUDGMENT

[1]The Claimant’s claim that he was unfairly dismissed is well-founded. The Respondent is ordered to pay to the Claimant the sum of £12,336.77 which is calculated as follows: Basic award: £ 978.00 (2 x £489.00) Compensatory award: £11,358.77 (comprising loss of statutory rights in the sum of £300 and loss of earnings in the sum of £11,058.77)[2]The Respondent failed to give the Claimant notice or pay him in lieu. The Claimant’s claim for breach of contract succeeds. The Respondent is ordered to pay the Claimant damages in the sum of £1,343.47 net.[3]The Respondent made unauthorised deductions from the Claimant’s wages and the Respondent is ordered to pay the Claimant the sum of £1,950.00 gross.[4]The Respondent’s claim for holiday pay is dismissed.[5]The Respondent failed to provide the Claimant with a written statement of employment particulars and the Respondent is ordered to pay the Claimant the sum of £978.00 (2 weeks capped pay).
