Miss C Pastor Pastor v A Long: 2303630/2022
JUDGMENT
The claim for a redundancy payment is struck out.REASONS
[1]By a letter dated 18/11/2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim for a redundancy payment should not be struck out because• it has no reasonable prospect of success because under section 155 of the Employment Rights Act 1996 employees are not entitled to a redundancy payment unless they were employed for two years or more and it appeared from the claim that the Claimant was employed for less than 2 years.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim for a redundancy payment is therefore struck out.
