[1]The Claimant has failed to comply with the case management orders of 30 November 2022 and 27 April 2023 in that he has not provided a schedule of loss, complied with disclosure directions or provided a witness statement.[2]The Claimant has failed to attend this hearing or seek an adjournment, despite being given adequate notice.[3]The Claimant is not actively pursuing the claim.[4]The Respondent’s application to strike out the claim under Rules 37(1)(c) and 37(1)(d) of the Employment Tribunal Rules of Procedure 2013 (as amended) is allowed.[5]The Claimant’s claim is hereby struck out under Rules 37(1)(c) and 37(1)(d).
