[1]Claim no. 2303591/19 and claim no. 2300868/20 are both dismissed.REASONS
[1]This has been a remote hearing on the papers, which the parties have not objected to. The form of remote hearing was: V - video. A face to face hearing was not held because it was not practicable and the issue of the future determination of the claim could be resolved from the papers. The documents that I received were those contained in the Tribunal case file.[2]The Claimant did not participate in this hearing. The tribunal clerk tried to call her, but the number listed was unobtainable. He also tried the different number on her second claim, but there was no answer.[3]I decided to continue in her absence, strongly influenced by that fact that EJ Truscott QC had directed her on the last occasion (3 June 2020), when she also failed to participate, that she should inform the tribunal if she was Case Numbers: 2303591/19/V and 2300868/20/V continuing with her claim. She did not do so and Mr Darley told me that he had heard nothing from her either.[4]In those circumstances and bearing in mind that this was an adjourned hearing, I could see no reason to re-list the hearing. There is nothing before me to suggest that the Claimant is actively pursuing her claim and, in any event, the tribunal would not have jurisdiction to hear her unfair dismissal claim, as she lacks sufficient continuity of service. I am therefore dismissing her claim.[5]For reasons that are unclear, the Claimant seems to have brought essentially the same claim in an ET1 dated 2.3.20 (2300868/20), which I am told has not been served as yet. For the avoidance of doubt, I am dismissing that claim also.
