JUDGMENT
[1]By a Case Management Order dated 25 April 2023, Employment Judge Braganza KC directed the Claimant, Ms Kimberley Lamont, to inform the Tribunal by 2 May 2023 whether she intended to proceed with her claim against the Respondent, Mr Louis Brown. The Claimant was also directed to provide specific details regarding her claim for unpaid wages and holiday pay by the same date, if she wished to proceed with her claim.[2]The Claimant has failed to comply with the directions contained in the Case Management Order dated 25 April 2023. No communication has been received from the Claimant to date, confirming her intention to proceed with the claim or providing the requested details.[3]In the circumstances, the Tribunal concludes that the Claimant is no longer actively pursuing her claim against the Respondent.[4]Furthermore, the Claimant's failure to comply with the orders given by the Judge amounts to a failure to comply with an order of the Tribunal, as per Rule 38(1)(c) of the Employment Tribunals Rules of Procedure 2024.[5]Accordingly, pursuant to Rule 38(1) of the Employment Tribunals Rules of Procedure 2024, the claim of Ms Kimberley Lamont against Mr Louis Brown, case number 2303590/2022, is struck out in its entirety.
