D Lynton v M Williams: 2303562/2022

EMPLOYMENT TRIBUNALS
Case No 2303562/2022
D LyntonClaimantM WilliamsRespondent
Employment Judge Fowell DateDate 28 June 2023

JUDGMENT

The claim is struck out for failure to comply with the Tribunal’s directions and because the claim has not been actively pursued.

REASONS

[1]The claimant failed to attend the hearing of this claim on 18 April 2023.[2]An order was given on 19 April 2023 requiring that she write to the Tribunal explaining her failure to attend and her failure to comply with the Tribunal’s previous orders dated 1 November 2022, setting out the steps needed to prepare for that hearing.[3]The deadline for responding to that order was 11 May 2023. No reply has been received.[4]By email dated 31 May 2023 the claimant’s representative wrote to say that there was a confusion of cases and case numbers and that no communication had been received from the Tribunal since this claim was lodged.[5]The Tribunal’s records however show that the original order dated 1 November 2022 was sent to the email address used by the representative, as were the connection details for the hearing. This explanation is therefore not accepted.
