They are set out only to the extent that the Tribunal considers it necessary to do so in order for the parties to understand the Judgment. They are further, set out only to the extent that it is Case Number: 2303526/2019 proportionate to do so.[2]All facts were found on the balance of probabilities.[3]By a claim form that was presented on 22 August 2019, the Claimant contended that the Respondent had made unlawful deductions from his wages. However, he did not attend the hearing and it was not possible to determine from the claim form what sums he was claiming to be due to him. The burden of proving that unlawful deductions had been made rests on the Claimant. In all the circumstances therefore, the Tribunal dismissed the claim.
