It does not appear that the claimant intended to present a separate complaint in respect of notice pay as she did not tick the appropriate box on the claim form.[2]In any event, it is not open to her to claim that the respondent ought to have paid her notice pay following her resignation, in circumstances where she was not willing to attend work. Such an argument would has no reasonable prospects of success.
