The respondent’s application dated 9th February 2024 for reconsideration is refused.REASONS
The respondent’s reconsideration application of 9/2/2024 was only referred to EJ Wright on the 26/6/2024 after 4pm and when she was sitting on day 10 of 30 with multiple claimants. That is notwithstanding that EJ Wright considered a separate matter on the file on the 17/6/2024. The outstanding application was not drawn to her attention at that point. EJ Wright considered the application on the 27/6/2024. There does not appear to be any material change in the respondent’s position other than to say, put colloquially, ‘the Judge was wrong’. That is not the basis for a decision to be reconsidered. A reconsideration application does not afford a party the opportunity to put the application again in order to seek a different decision. If the decision is wrong in law, then it is open to the respondent to appeal. It may well be that due to the passage of time since the application was made and in view of the lack of response from the administration, that the respondent has appealed in any event (and factoring in, the time limits for an appeal). The application is refused.
