JUDGMENT
BY CONSENT UPON reading the joint application submitted by the Claimants on behalf of the parties AND UPON the parties having agreed to the terms of the Judgment set out below by consent The Judgment of the Employment Tribunal made under Rule 64 of Schedule 1 of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013 is that, following settlement between the parties with no admission of fault or liability: Consent for the claims listed in the schedule attached to this Judgment to proceed against the Respondent and the lifting of the moratorium in relation to them is granted by the administrators of the Respondent. Protective Award A protective award pursuant to section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 is made in respect of the Claimants listed in the schedule attached to this Judgment. The Respondent is ordered to pay remuneration to the Claimants listed in the schedule attached to this Judgment for a protected period of 56 days from 30 April 2019 (being the date on which the first of the dismissals to which the complaint relates took effect). Permitted Claims Following submission by a Claimant listed in the schedule attached to this Judgment and acceptance by the Respondent of a valid proof of debt, the parties agree that such a Claimant shall be entitled to prove for a dividend in the administration estate of the Respondent as an unsecured creditor only. This condition has no bearing on any claim against the Secretary of State in respect of payment for the 56-day protective award listed in clause 2.1 above. Costs There shall be no order as to costs and each party shall bear their own costs in these proceedings.
