REASONS

[1]The respondent did not return an ET3.[2]The Tribunal heard evidence from the claimant that established that he was a worker and hence entitled to holiday pay.[3]The claimant has had substantial correspondence with the respondent about outstanding holiday pay for the holiday year ending April 2016 and April 2017. There were no other sums due to the claimant for the period after April 2017 until his holidays on 28 January 2018 and 4 February 2018 where he was due £195.51 and £78.19 of which he was paid £115.82. The sum outstanding was £157.88.[4]The Tribunal permitted the claimant to amend his claim to seek this sum.[5]The Tribunal considered that section 23(2) of the Employment Rights Act 1996 prevented it from having jurisdiction to address the other outstanding sums.
