JUDGMENT

This judgment is entered under Rule 21 of the Employment Tribunals Rules of Procedure 2013[1]The Respondent made unauthorised deductions from the Claimant’s wages and the Respondent is ordered to pay to the Claimant the sum of £1,836.51[2]The Tribunal makes the following declaration: the Respondent failed to provide the Claimant with itemised pay statements.[3]The Respondent failed to provide the Claimant with a written statement of employment particulars as required by section 1 of the Employment Rights Act 1996 and the Respondent is ordered to pay to the Claimant the sum of £443.94 (two weeks’ pay).

REASONS

[1]The Claimant claimed unlawful deductions from wages and complained that the Respondent failed to provide itemised pay statements showing deductions made from her wages. The Respondent failed to present a response to the claim.[2]The Claimant was employed by the Respondent from 7 October 2017 to 24 August 2018 as a Sales Coordinator working 3 days/21 hours each Case No: 2303215/2018 week. Her wages were £73.99 per day.[3]The Respondent failed to pay the Claimant for work carried out in June 2018 for which wages are due in the sum of £1,136.23 and for two days work in July 2018 for which wages are due in the sum of £147.98. For the last six weeks of her employment, the Claimant was on sickness absence. The Respondent failed to pay her statutory sick pay at the rate of £92.05 per week.[4]The Respondent failed to provide itemised pay statements (although he did issue two pay statements purporting to have been issued by Sundridge Interiors Limited).[5]The Respondent failed to provide the Claimant with a written statement of employment particulars.
