JUDGMENT

[1]The Respondent will pay the Claimant the sum of £1,518.35 in unpaid wages and holiday pay.

REASONS

[1]This was a claim for unpaid wages and holiday pay. Judgment in default of a response was previously entered, so this hearing was concerned only with the amount of the judgment. Mr Plunkett attended and was allowed to participate in the hearing.[2]The Claimant told me that she was employed from 6 June to 20 July 2018 by the Respondent, which was a total of 6 weeks and 2 days. Her payslips showed that her net weekly earnings were £274.05. She was also entitled to 3 days in respect of annual leave, giving a total of 7 weeks’ pay or £1,918.35. 10.7 Judgment with reasons – rule 62 March 2017 Case No: 2303198/2018[3]However, the Claimant did not receive her pay (although she did receive her pay slips). All she was paid was a “deposit” of £400. Therefore, the amount she was owed was £1,518.35.[4]Mr Plunkett accepted that she had not been paid, saying simply that the company did not have the means to pay her. However, as he accepted, this was a debt that needs to be paid.
