[1]The claim has not been actively pursued and is struck-out pursuant to rule 37(d).REASONS
[1]The claim was presented in July 2021. Since that time the Claimant has not corresponded with the tribunal at all.[2]There was no activity on the case (aside from the response being entered) until Employment Judge Webster wrote to the parties on 6 March 2021 asking if the claim was live and whether the Claimant wished to pursue it. A reasons was required by 13 March 2023. She warned that a failure to answer could lead to the case being struck out.[3]The Respondent answered stating that there had been not activity. The Claimant did not answer.[4]From the history above, it is obvious that the claim has not been actively pursued. It appears that the Claimant has abandoned the claim and has no intention in pursuing it henceforth. I think it would be unfair and prejudicial to the Respondent for this claim to continue in the circumstances. The tribunal’s resources are finite.[5]In all the circumstances, the time has come to bring this claim to an end.
