JUDGMENT
[1]The name of the Respondent is amended by consent from “Hamptons” to “Countrywide Estate Agents Limited”.[2]The complaints that the Claimant is owed notice pay, holiday pay and arrears of pay are dismissed following withdrawal by the Claimant at a public preliminary hearing on 10 January 2024.[3]The Claimant’s complaint based on negligent misrepresentation is struck-out:a. Because the Tribunal does not have jurisdiction to hear it;b. Or, in the alternative, because it has no reasonable prospect of success.[4]The Employer’s Contract Claim will proceed, but the Respondent is Ordered to write to the Tribunal and the Claimant on or before 24 January 2024 to clarify whether it wishes to pursue that claim.
