JUDGMENT

[1]The Respondent failed to pay the Claimant notice pay, in breach of her contract.[2]Accordingly, the Respondent shall pay the Claimant the outstanding sum of £1,124.43 (one thousand, one hundred and twenty four pounds and fourty three pence).[3]The Claimant’s application to amend her claim to include a claim for a protective award under Section 189 of the Trade Union & Labour Relations (Consolidation) Act 1992 (TULRCA) is allowed.[4]The Respondent failed in its duty to consult appropriate employee representatives on redundancy pursuant to section 188 of TULRCA. The number of employees dismissed exceeded 20 and the dismissals occurred without any collective consultation on redundancy.[5]The Claimant’s claim for a protective award is well founded.[6]The Protected Period started on 1 July 2019. The Tribunal awards 90 days’ pay in respect of the Claimant pursuant to Section 189 TULRCA.
