JUDGMENT
The complaint of age discrimination is struck out.
REASONS
[1]The claimant was ordered to pay a deposit of £750.00 following a preliminary hearing held on 30 October 2018. The Order was sent to the claimant on 9 November 2018. The claimant has failed to pay this deposit. The complaint of age discrimination under the Equality Act 2010 is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]No further hearings have been fixed. _____________________________ Employment Judge Judge's Surname Date: 16 April 2019 Case Number: 2303011/2018 6.2 Strike out Judgment – claim - rule 37 EMPLOYMENT TRIBUNALS Claimant: Mr B Nowbati Respondent: United Living (South) Ltd[1]By an Unless Order made on 30 October 2018 and sent to the parties on 9 November 2018 the Tribunal gave the claimant an opportunity to explain, by no later than 16 November 2018 why the claim should not be struck out without a hearing or further consideration because he was not entitled to bring a claim of unfair dismissal having regard to his length of service and the requirement in section 108 of the Employment Rights Act 1996 (two years’ service).[2]The claimant has failed to make any sufficient representations in writing, why this should not be done. The claim is therefore struck out.[3]There is no further hearing fixed to take place.
