The Judgment of the Employment Tribunal is that:- The claim is dismissed.REASONS
[1]By a claim form which was presented on 30 July 2019 the Claimant complained that she had suffered an unlawful deduction of wages in respect of non-payment of arrears of pay including holiday pay. She did not attend the hearing and had sent in no details to permit the Tribunal to assess the validity of her claim. In those circumstances the Tribunal could not be satisfied on the balance of probabilities that either the Claimant was entitled to the sums that she claimed or that they were still Case Number: 2302992/2019 outstanding and due to her.[2]The claim was for 11.5 weeks’ pay at £480.00 per week. It was unclear whether this was a net or gross figure. She described that it had been agreed that she would be paid. The Tribunal needed to consider whether there was a valid contract and whether there was an issue of illegality. In all the circumstances, the Tribunal considered that it was in the interests of justice to dismiss the claim.[3]Written reasons are provided as neither party attended the hearing.
