Mr J McFarlane v Brettex Site Services Ltd: 2302895/2017
JUDGMENT
The Claimant’s claims under the above case number are struck outREASONS
[1]Following a preliminary hearing held on 19 June 2018, Employment Judge Corrigan issued case management orders which were sent to the parties 17 July 2018. Among other things, the Claimant was required to provide additional information relating to his claim of disability discrimination, an impact statement and a schedule of loss.[2]Employment Judge Balogun subsequently extended the time by which the Claimant was required to comply with the case management order. This was communicated to the parties by letter dated 23 November 2018.[3]Although the Claimant provided some medical evidence, he has not provided an impact statement nor provided details of his claim.[4]By letter dated 21 December 2018, the Respondent applied for the Claimant’s claim to be struck out.[5]By letter dated 7 February 2019, the parties were informed that Employment Judge Tsamados was considering striking out the claim because the Claimant had not complied with the Order of the Tribunal as amended. The Claimant was informed that if he wished to object to the proposal, he should give his reasons in writing or request a hearing at which he could make them by 14 February 2019.[6]The Claimant has neither complied with the Case Management Order as amended nor indicated his objections to his claim being struck out.[7]The case listed for hearing commencing tomorrow over four days before a full tribunal will not proceed.
