JUDGMENT

[1]The claimant’s complaint of unlawful deduction of wages is well-founded and the respondent is ordered to pay to the claimant £577.38, subject to deductions for tax and National Insurance.[2]It is not anticipated that there will be a need for deductions as the appropriate payments have been made to HMRC, and the second unpaid payslip included a tax refund.[3]The above figure is based on the following:3.1 October 2023 payslip (£1435.38 gross and £1311.50 net).3.2 November 2023 payslip (£570.08 gross and £665.88 net (including tax refund).3.3 Payments of tax and National Insurance have been made as required. The claimant has been paid £1400 in total, in instalments, leaving a balance owed to the claimant of £577.38, which was not disputed by the respondent.
