Mr S Bennet v City Electrical Factors Ltd: 2302752/2020
REASONS
[1]The respondent applied to strike out the claim on 31 March 2021.[2]On 17 May 2021 the tribunal issued the claimant with a warning that his claim could be struck out because he had not complied with an Order of the tribunal dated 2 November 2020.[3]The claim is now listed for a full hearing on 5 January 2022.[4]The respondents renewed their application that the claims be struck out on 13 August 2021.[5]On 28 October 2021 EJ Andrews ordered the claimant to do the following within fourteen days:a. Serve a schedule of lossb. Provide copies of his documents relevant to his claims andc. Provide his witness statement to the respondent.[6]It appears that the claimant has failed to comply and the full merits hearing is now just under one month away.[7]This is the claimant’s final chance to comply with the tribunal orders and ensure that the case is ready for hearing on 5 January 2022. If he has not complied with EJ Andrews order in full by 17 December 2021, his claims shall be struck out on the basis that he has not complied with tribunal orders and the claim is not being actively pursued.
