Employment Judge FergusonDate 20 January 2021

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 30 September 2020 the Tribunal gave the claimant an opportunity to make representations, as to why her complaint of unfair dismissal should not be struck out because it appeared from her claim that she was employed for less than two years. Although the letter referred to other complaints in the claim form, in fact unfair dismissal was the only complaint brought.[2]The claimant has failed to make representations in writing why her claim should not be struck out. Moreover the claimant has not responded to correspondence from the respondent on 2 December 2020 asking whether she was still pursuing her claim and has not contacted the Tribunal at all since her claim was presented on 1 July 2020.[3]The Tribunal is satisfied that the claimant does not have sufficient qualifying service to bring a complaint of unfair dismissal and the claim is not being actively pursued.[4]The claim is therefore struck out.[5]The hearing fixed for 23/06/2021 will not take place.
