JUDGMENT

The Claimant’s application dated 11 September 2018 for reconsideration of the judgment sent to the parties on 28 August 2018 is refused.

REASONS

There is no reasonable prospect of the original decision being varied or revoked because: The reasons given by the Claimant in his application do not show that reconsideration of the original decision is necessary. Although the Tribunal did not decide whether or not the Claimant had shown a prima facie case, it proceeded on the assumption that he had done so thus giving him the benefit of the doubt at that stage of the Tribunal’s reasoning (see paragraph 41 of the Reasons). The Respondent thus had the burden of showing that it did not discriminate against the Claimant. The Tribunal was satisfied that the Respondent showed that it did not discriminate against the Claimant for the reasons clearly expressed in the Reasons for the Judgment.
