JUDGMENT
(1) The Claimant’s complaints for a declaration that the First Respondent failed to comply with S.188 TULRA 1992 is well founded.(2) The First Respondent is also ordered to pay, pursuant to S. 189 (4) TULRA 1992 remuneration for the period of 90 days from 16 May 2022 to all Claimants (see attached Schedule) who were made redundant on that date. For the avoidance of doubt, the Tribunal finds all Claimants (see attached schedule) were made redundant on this date.(3) Upon the First Respondent’s insolvency the Second Respondent shall be responsible for the First Respondent’s liability subject to the appropriate limits.
