JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 47[1]The Claimant’s claim for unauthorised deduction from wages is dismissed under Rule 47 of the Employment Tribunal Rules of Procedure.

REASONS

[2]There was no appearance by the Claimant at the hearing of the claim on 18 May 2021. There was no correspondence from the Claimant asking for an adjournment of the hearing or advising that he would be unable to attend.[3]The Tribunal satisfied itself that on 12 May 2021 at 2.31pm both parties were emailed the Notice of the Hearing for 18 May 2021 and provided with the log in details for that hearing.[4]The Tribunal made reasonably practicable enquiries on the morning of the hearing on 18 May 2021 to confirm whether the Claimant would be attending.[5]The clerk to the Tribunal telephoned the Claimant four times on the mobile details provided in the Claimant’s ET1. The clerk to the Tribunal also emailed the Claimant on the morning of 18 May 2021 using the email address provided in the ET1. The Claimant did not respond to the telephone calls or the email.
