Mr O Bakare v Iron Mountain (UK) plc: 2302096/2020

EMPLOYMENT TRIBUNALS
Case No 2302096/2020
Mr O BakareClaimantIron Mountain (UK) plcRespondent
Employment Judge Ferguson DateDate 6 July 2021

JUDGMENT

The claim is struck out.

REASONS

[1]By an “unless order” sent to the parties on 15 June 2021, the Tribunal ordered that unless the claimant provided a schedule of loss and copies of all documents relevant to his claim to the Respondent by 21 June 2021 the claim would be struck out.[2]The claimant had also been warned by letter dated 24 February 2021 that his claim was at risk of being struck out if he did not send the respondent a schedule of loss and copies of documents relevant to his claim within 14 days.[3]The claimant has not informed the Tribunal that he has provided the documents to the respondent and has not corresponded with the Tribunal at all in response to either of the above warnings. The claimant does not appear to have corresponded with the respondent either.[4]The claim is therefore struck out on the grounds that it is not being actively pursued and/or the claimant has failed to comply with orders of the Tribunal.[5]The hearing fixed for 22 July 2021 will not take place.
