JUDGMENT

It is the Judgment of the Tribunal that the Claimant’s complaint of disability discrimination is struck out.

REASONS

[1]By Order sent to the parties on 23 January 2024 EJ Wright Ordered that the Claimant’s claim of unlawful disability discrimination had little prospects of success. He was ordered to pay £100 not later than 21 days from the date the Order was sent. The deadline for the Claimant to make the payment was therefore 13 February 2024.[2]Rule 39(4) of the Employment Tribunal Rules of Procedure provides “If the paying party fails to pay the deposit by the date specified the specific allegation or argument to which the deposit order relates shall be struck out…” [Tribunal emphasis][3]The Claimant did not pay the deposit by 13 February 2024, he paid it late on 23 March 2024. The complaint is therefore struck out.[1]The complaint of automatic unfair dismissal because of making a protected disclosure is not well-founded and is dismissed.[2]The complaint of unfair dismissal is not well-founded and is dismissed.
